Abstract Content *
The domestic violence in the Republic of Macedonia was prescribed for the first time in 2004, when the Criminal Code was amendment with a number of provisions. The intent of the legislator was very clear - the criminal justice system should adopt a firm attitude regarding this type of violence and the injuries caused by it. This was the main reason why it was defined as ill-treatment, cruel insulting, endangering safety, bodily harm, gender or other mental or physical violence that produces feeling of insecurity, endanger or fear, towards spouse, parents or children and other persons who live in marital or extramarital union or communal household, as well as towards ex-spouse or persons who have joint child or close personal relations.
The criminal-legal framework of the domestic violence illustrates its stipulation as a graver circumstance in nine articles of the Macedonian Criminal Code in the chapters dedicated to the criminal acts against life and body, against freedoms and human and citizen rights, as well as against sexual freedom and sexual moral. Regarding the sanction that shall be imposed to the responsible person, it depends from the determination of his / hers criminal culpability. The analysis that shall be performed will help the relevant authorities to act in a way of an old Macedonian proverb it is better to prevent it, rather than to heal it.
